TUPE or not TUPE that is the question!

Recently, we have been working with a number of clients who are fortunately doing very well despite the uncertainty created by the pandemic and are acquiring other companies as a result (yay!)

When acquiring a company, you need to see if TUPE applies...

The Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) aim to protect both jobs and terms and conditions when businesses are bought and sold or activities are moved between organisations, e.g. during out-sourcing. In simplistic terms, this means that when work moves from one organisation to another, the employees doing that work move with it and are largely protected from being disadvantaged by the move.

In short, you need to cover yourself and your business by following the correct steps, know how to consult and fully understand the process... TUPE can be a legal minefield so always seek legal advice if you are unsure!
